[Statement] South Korea Stands Firm: Defending Freedom and Democracy Against Martial Law

The Asia Democracy Network commends the people of South Korea for their swift and resolute rejection of martial law, declared by President Yoon Suk-yeol on December 3, 2024. This powerful display of conviction and unity by the Korean people reaffirms their sovereignty and their role as true defenders of freedom.

Declared without credible justification or evidence of imminent danger, President Yoon’s martial law order posed a grave threat to South Korea’s hard-won democratic values. In response, the National Assembly convened an emergency session on December 4, swiftly and unanimously overturning the declaration. Their actions exemplify the vital role of strong institutions in safeguarding democracy against executive overreach.

Equally notable was the peaceful and rapid mobilization of citizens across the country. People gathered in large numbers, even late into the night, to voice their commitment to democratic principles and fundamental freedoms. This collective mobilization of South Koreans from diverse backgrounds —demonstrates the essential role of an engaged citizenry in protecting democracy. It is a reminder that democracy is not merely a system of governance but a shared responsibility that thrives through active public participation. 

President Yoon’s actions have raised serious constitutional concerns. Article 77 of the Constitution permits martial law only in cases of national emergency, such as wartime or widespread disorder. The absence of any clear or present danger makes this declaration both unjustified and unconstitutional. The swift and decisive response of the National Assembly underscores the importance of checks and balances in preventing the abuse of power.

This victory, however, is not just a celebration but a call to vigilance. Democracy thrives when citizens remain engaged and hold their leaders accountable. The motivations behind this unprecedented move must be thoroughly investigated, ensuring that the sanctity of democratic governance is never compromised again.

The Asia Democracy Network stands in solidarity with the people of South Korea and applauds their dedication to protecting democratic principles. This moment serves as a reminder of the collective responsibility to defend and nurture democracy across Asia and the world. 

Democracy thrives when citizens, institutions, and leaders work together to uphold its values.  The actions of South Korea’s people and institutions reinforce the belief that democracy, though fragile,  can endure with vigilance, unity,  and steadfast commitment.
